Medical Malpractice

Virginia C. Nelson obtained a $4,927,975 verdict on behalf of a 27 year-old female lab research associate whose arm became paralyzed following surgery to remove her cervical and first ribs.

Virginia C. Nelson obtained a settlement for $4,500,000 on behalf of a child and relatives following a failure to diagnose and treat a fetal bleed during labor. This failure to identify and treat the problem by earlier caesarean section led to catastrophic brain and kidney damage.

Virginia C. Nelson obtained a $3,000,000 settlement for a child and her parents after her doctors failed to recognize and treat pregnancy hypertension, fetal distress, and as a result plaintiffs suffered severe irreversible brain damage. At delivery, the mother showed signs and symptoms of an impending placental abruption due to pregnancy induced hypertension that went unattended. There was a delay in delivering the baby, and severe brain damage occurred as a result.

Virginia C. Nelson obtained a $799,869 verdict after a 10 day trial on behalf of a 41 year old former Marine and his wife. The patient was injured after he was improperly positioned and padded during back surgery. As a result, he suffered a bilateral brachial plexus injury which impaired the motor function in both of his hands.

Virginia C. Nelson successfully obtained a settlement for $3,400,000 on behalf of a 54 year-old software instructor. The patient was admitted to a hospital emergency room for severe dehydration. There she was diagnosed as having a critically low sodium level and was immediately given a sodium replacement by the defendant doctor. However, she was given an incorrect dosage of the sodium replacement. After she was given the dosage, she lapsed into a coma resulting in severe and permanent brain damage.

Virginia C. Nelson and Noel A. Fischer obtained a $1,900,000 settlement on behalf of a child and her parents after a maternal-fetal hemorrhage was not properly diagnosed. The delay in diagnosis caused severe birth defects, including brain damage.

Virginia C. Nelson obtained an $800,000 settlement on behalf of a 35-year-old cosmetology instructor after a misread pap smear led to a delay in diagnosis of cervical cancer. This delay resulted in a reduced life expectancy.


Personal Injury

Virginia C. Nelson and Noel A. Fischer obtained a total $1,900,000 in settlement for a widow and her 10 year-old daughter after their husband and father was injured in a dune buggy accident. He was then negligently deprived of oxygen by hospital staff who were attempting to treat the injuries he suffered in the collision. He lapsed into a coma and died as a result.

Virginia C. Nelson obtained over $600,000 in settlement on behalf of two men who were injured when a manbasket they were in was dropped by a crane to the dock.

Virginia C. Nelson obtained a $717,000 settlement on behalf of a 19 year-old college student when the driver of the car he was riding in lost control and hit a tree on Torrey Pines Road. The student had to miss a year of college due to his injuries.

Virginia C. Nelson obtained a $645,000 settlement for a married couple whose fetus was born prematurely and died as a result of an automobile collision.

Virginia C. Nelson handled all the San Diego cases involving the fertility scandal at U.C. Irvine. Those eight cases settled for confidential amounts.


Kaiser

Virginia C. Nelson represented the heirs of a man in a medical malpractice claim against Kaiser for failing to diagnose and treat long-standing coronary artery disease. Ms. Nelson successfully obtained a $2,500,000 arbitration award for the heirs.

Virginia C. Nelson obtained a $1,016,049 arbitration award against Kaiser on behalf of a 30 year old teacher's aide whose colon cancer escaped detection due to a failure to act upon an abnormal pathology report.

On August 7, 2002, a husband and wife came to Kaiser for the birth of their third child. The evening after the birth, the wife had excruciating back and leg pain and was unable to urinate. There was a four-day delay in diagnosis of cauda equina syndrome, or a compression of the spinal nerve roots by a herniated disk. As a result of that delay, the wife sustained permanent nerve and muscle injury including interruption of bladder and bowel function as well as saddle anesthesia. Virginia C. Nelson successfully handled an arbitration for the delayed diagnosis of cauda equina syndrome. The delayed diagnosis caused injury to muscles and nerves including bladder function, bowel function and saddle anesthesia. The arbitration panel awarded $1,276,335 based upon a systems failure against Kaiser.

Virginia C. Nelson and Noel A. Fischer won a $378,466 award following arbitration against Kaiser. Kaiser personnel had repeatedly failed to properly treat a 52 year-old man's middle-ear infection. As a result of this negligent treatment, the ear infection became more serious, broke out of his ear and traveled down the neck into his chest. This condition resulted in the man's death. Ms. Nelson and Mr. Fischer obtained the award following a 6 day arbitration after there was no offer in the case. Ms. Nelson and Mr. Fischer obtained their costs in the matter, increasing the total recovery to $450,000.

Virginia C. Nelson has obtained as a lawyer, or participated in as an arbitrator, over $40,000,000 of Kaiser arbitrations and settlements.
